Mediation Practitioners Certificate

The Mediation Practitioner’s Certificate is designed for individuals who want to feel more at ease mediating conflict as part of their jobs or for those who are planning to be self-employed as private mediators. 

The program will enhance and build upon communication, negotiation, problem-solving, analytical and conflict resolution skills. It will provide participants with essential theoretical and practical skills required by a mediator. 

Certificates are issued when a participant meets the requirements that are “locked-in” when they register for the certificate; all requirements must be met within 3 years. 

Participants will learn:

  • what mediation is as a philosophy and as a process
  • what the qualities of a good mediator are
  • what you need to know and do to be effective as a neutral third-party mediator
  • what skills you already have that you can bring to the mediation table
  • conflict and negotiation theory
  • a phased mediation process framework used by skilled practitioners
  • how to prepare for mediation, set a tone for positive discussion of diverse expectations
  • how to delve into the underlying objectives of the parties to help emphasize shared interests
  • how to effectively structure agreements and finalize outcomes
  • how to use knowledge of personality type to better understand sources of conflict and type-sensitive strategies for resolving it
  • how to identify potential ethical issues in mediation and to resolve them using ethical principles and applicable codes of ethics/professional conduct  

Duration: The program consists of 154 hours of mediation training, delivered in one-, two-, and three-day workshops.

Essentials of Conflict Resolution

This introductory core course examines principles, concepts and techniques of the interest-based approach to conflict resolution.  You will learn five modes of conflict handling and their uses, conflict self-awareness, conflict analysis, communication for improving relationships, interest-based negotiation, stages of problem solving, and applications in interpersonal one-to-one negotiation. 
 
Participants will gain practical skills to be able to:

  • Understand the five styles of conflict handling and their uses
  • Identify their own conflict self-awareness
  • Conduct a conflict analysis 
  • Effectively use communication skills to improve relationships
  • Apply interest-based approaches to resolve conflict in one-to-one interpersonal disputes

Prerequisites: There is no prerequisite for this course. This course prepares participants for admission to all other courses in the Program in Conflict Resolution Studies at UPEI.

Understanding and Resolving Conflict Through Personality Type

The Myers-Briggs Type Inventory (MBTI) is a Personality Type Tool that identifies personality preferences and helps individuals to know and understand their own dynamic personality type.
 
This course focuses on using knowledge of personality type to better understand the sources of conflict and how we respond to it.
 
Through group activities, lectures and discussions, participants will:

  • Gain awareness of their own and others’ individual personality preferences;
  • Examine normal differences that occur in how people perceive information and make decisions;
  • Examine the relationship between personality type and stress;
  • Explore the various sources of conflict for different personality types;
  • Examine how different types respond to conflict and discover various type-sensitive strategies for dealing with conflict;
  • Examine what each type needs from others in order to resolve conflict;
  • Explore the MBTI Problem-Solving Model for using type to make more effective decisions.

Drafting the Agreement to Mediate and Memorandums of Understanding

In this course, participants will examine the role of the Agreement to Mediate (setting out the terms on which a mediation is to be conducted) and of the Memorandum of Understanding (used to document outcomes agreed upon by the parties). Participants will practice organizing and drafting Memorandums of Understanding.

Through group activities, lectures and discussions, participants will:

  • Examine the purpose of an Agreement to Mediate;
  • Discuss who should sign the Agreement to Mediate and examine the terms that are typically included in an Agreement to Mediate;
  • Discuss situations in which mediation may not result in parties’ reaching agreement;
  • Examine the role of a Memorandum of Understanding and discuss how it differs from a legally binding agreement;
  • Examine the types of provisions that might be contained in a Memorandum of Understanding;
  • Learn how to organize and draft a Memorandum of Understanding.

Ethics in Dispute Resolution

This core course examines the role of the mediator (conflict resolver) in the light of ethical theories and principles, as well as professional codes needed to guide practitioner conduct.

Participants will gain practical skills to be able to:

  • Understand the links between ethics and mediation
  • Examine when and how ethical issues arise during mediation
  • Examine ethical principles and their relationship to mediation
  • Understand the importance of ethical practices as they pertain to mediation
  • Examine codes of ethics of professional conduct of various professional bodies that regulate the practice of mediation 
  • Develop critical thinking skills to assist in the identification of potential ethical dilemmas
  • Discuss fundamental ethical considerations of alternative dispute resolution
  • Identify factors that contribute to conflicts of interest and bias

Advanced Mediation: Preparing Yourself and Your Clients for Success

This three-day experiential workshop builds on the skills and processes taught in Essentials of Conflict Resolution and Interest-Based Mediation. Through case studies, lectures and group discussions, participants will learn and practice advanced techniques and strategies for assessment of the conflict and ways to best prepare themselves and the parties for successful mediation.

Participants will gain practical skills to be able to: 

  • Conduct effective information meetings
  • Analyze and screen the conflict and its suitability for mediation
  • Coach parties for collaborative decision-making
  • Identify the key issues and interests to be addressed
  • Employ techniques for dealing with power imbalances
  • Prepare for mediation/co-mediation

Advanced Practice Seminar

The three-day advanced practice seminar is designed to provide participants with an opportunity perfect their mediation skills and prepare for the Final Assessment.  A qualified assessor will provide an overview of material and guide participants through a “mock” assessment and provide individual feedback and coaching. 
This course includes: 
 
Day 1 – Review, Overview of the Final Assessment
Assessor will provide an overview of materials and expectations regarding practice, group formation and an outline of the final assessment. Following this session participants will begin practice with their group.
 
Days 2 and 3 – Structured Role Plays, Debriefing and Individual Feedback
All participants will engage in a two-day, in their session, in their assigned groups, to practice mediation skills and carry out mock assessments with instructors. Following the mock assessment, participants will be provided with written and oral feedback on their mock assessments and guidance for practice prior to the Final Assessment.
 
Participants will gain practical skills to be able to:

  • Refine mediation skills in preparation for Final Assessment
  • Understand the assessment process
  • Have a solid understanding of personal assessment readiness

Upon completion of this course, participants will demonstrate the ability to conduct a complete mock mediation, employing the skills, strategies and processes taught throughout the certificate program.

Final Assessment - Mediation Practitioners Certificate

In order to obtain a Mediation Practitioner’s Certificate, participants will be required to have their skills assessed by a qualified assessor. The assessment is formal demonstration that certificate candidates can apply mediation skills in practice.

Candidates will conduct a simulated mediation and have their practical skills assessed by a qualified assessor. Established criteria, known to the candidates, will be used to evaluate the candidate’s skills. Each stage of the mediation process and of the communication and mediation skills will be graded separately. The Candidate must obtain a mark of 70% for each section as well as an overall grade of 70% to pass the assessment. Candidates may repeat the assessment if necessary, at an additional cost.

Conditions 

  • Assessment must be taken within 60 days of Advanced Practice Seminar
  • Assessments will be videotaped for personal review by the candidate, and for use in situation of appeal
  • Evaluations will be conducted by qualified assessors
  • Established assessment criteria will be provided to the candidates in advance
  • Candidates may repeat the assessment, within 90 days, if necessary. However, additional fees will apply.

Assessments will take place between June 1 and 5, 2020.
